Let me tell you a little secret that you may not know about.
Major stock companies (like Getty, Jupiter and Corbis) actually use software to “encode” the pixels of their stock images. They do this, so that they can run a software program, that locates their images on the internet. That might not seem like a big deal to you, because the stock companies are just protecting their copyrights… and keeping thieves from stealing images, right?
Isn’t that a good thing?
Well, just imagine for a moment that you hired a wonderful website designer to create your website about 3-4 years ago. The designer you hired, did a super job, and you love the design. You’ve been able to make some decent money from that site, and all is well on the internet.
Then one day you get a letter in the mail. It says that you have 3 illegal images on your website (that was designed 3-4 years ago) - and that you are being fined 3,000.00 for those images.
Are you some kind of image thief like they state in their letter?
Of course you’re not.
You put your faith into a website designer. You didn’t pick out the images - the designer did. Coming from personal experience as a website designer myself, I do like it when my clients put trust in me. They should be able to do that, because after all - they are paying me not only for my design work… but also for my knowledge of image use.
Sadly, any one of us can make a mistake - and most times, it’s really not our fault. Most designers do their “due diligence” to make sure the stock that we use is within terms. Most website owners are NOT image thieves, they are just misinformed.
The problem is, that major stock companies don’t care where you got the images, even if you downloaded them for free from their very own website. Some stock houses don’t record these free downloads, only to turn around later and smack a big fine on some innocent soul who only downloaded one of their free stock images. Most people don’t INTEND to steal ANYTHING.
Designers, small business owners, bloggers… doesn’t matter who you are, if you are found with an “illegal image” on your website - you can be fined. It’s as easy as that.

Michelle Brouse here, with a newly updated report that was written just for YOU! If you don’t know much about me, I’m just a “graphic chick” who learned how to create websites somewhere around 1997-98. By 1999 I was designing internal internet sites for a large company called CTG in Cleveland, Ohio. Nobody told me about these types of fines back then, and nobody gave me good information on which stock houses to use. When I worked in a major corp. we had “Corbis discs” at the time.
This information has come directly through the experiences of others over the past several years. Thankfully, I’ve never personally been fined… yet. Matter of fact, just last week I got another call. Coincidentally right after this report was updated to reflect all the changes in image terms for 2009.
A programmer that created one of my sites called to let me know that another site owner had been fined two thousand dollars for two small images. And that my site had the same images. So I’m in line to get a letter myself.
I’m thinking, “Well, isn’t that just peachy.”
As careful as I have been in the last few years since I learned all about image rights… and now I might get a letter too.
I haven’t, and it’s purely speculation at this point, but I MIGHT.
All because I trusted the designer of the site, and because I didn’t see any images on the site that would make me uncomfortable. In fact, I did ask where all the images came from, and the programmer said they were mostly all public domain. I believed it. Nothing looked particularly fancy.
Any one of us can make a mistake, unless we know exactly what we’re doing - and where to get images that won’t get us into trouble. Even then, a stock house can change their terms, making your image illegal without you even knowing about it.
BUT…

Rights on images have been a huge concern for quite some time now. If you get caught using “illegal images” on your websites you could be fined very heavily. Last I heard (just last week) it was around $1,000.00 per image. Yes, I said PER IMAGE.
Just 5 illegal images on any ONE of your websites can cost you up to $5,000.00 bucks! Imagine if you have about 30 websites like I do.
They don’t have to be profitable. They could be sitting there doing absolutely nothing - just a forgotten site that you meant to do something with and never did. If there is an image on that old forgotten site that hasn’t made you a dime, that turns out to be illegal… guess what.
They will fine you just the same. They don’t care - more cash for them.
Now, I will link you to a resource where the discussion got hot and heavy about this issue, and you will be able to figure out what to do if you DO get fined… but why not just eliminate the entire issue in the first place? Right when you set up your website.
“Merry Christmas To Me!”
That was the title of a thread in one of my favorite forums (The Warrior Forum) around Christmas of 2006-2007. I was completely astounded by what I read. This poor fellow had a designer create his website graphics for him. The site had been up for some time, and everything had been fine for a while.
Right before Christmas, of all times… this man got a note from one of the major stock companies telling him that he had “illegal” images on his website. He did everything he could to figure out what was going on, including contacting his designer.
Here the designer had unknowingly bought some stock discs from eBay that had illegal images on them. She didn’t know she was using illegal images, and neither did he. It was an eye-opening thread, to say the least.
Well, guess who ended up paying for it.
The poor guy who had the “illegal” images on his website. If I remember right, he actually had 3 images that were illegal, and they wanted 3 grand per image. He had no way to get out of it, so he had to pay. That’s about 9 thousand bucks, and no, I am NOT making this up.
Highway robbery.
No, “stealing” images is NOT a good thing. I don’t agree with that, and always either buy my images, or find them from the right resources. But certain major stock houses are being just a bit unreasonable, don’t you think?
The problem is, that they rarely listen to reason - they don’t care about your story, and some don’t even track downloads. They track by pixel. So they have no clue whether you actually quote “bought” the image or not. If you paid a designer you “bought” the image, and therefore the designer should be responsible for the fine, right?
Not so.
Not in the eyes of the big stock house company.
The problem is, that IF you paid a designer, and you can’t get ahold of them to find out where your site images actually came from - then you have no proof of purchase. That is what some of these stock houses count on. After 3-9 years, who has that kind of information backed up?
Who, after 5 years can go back and find the original purchase agreement?
If you have proof of purchase you’re in the clear my friend, and good on you for being one of the rare people who can do that… but as a general rule, most people do not. And the major stock houses know this. Don’t think that they don’t. ***Keep that in mind on your next image hunt!***
Now, I don’t know what happened with that particular original poster, nor what happened with his designer… but I can bet that this guy was very hurt. Not only mentally, but in his business. Small business owners can NOT afford to pay out nine thousand dollars to a major stock company like that without it seriously affecting their business. Even two thousand is a stretch!
Don’t Let It Happen To You!
Why should you allow yourself to be caught dead in the water with some “bad” images laying around? Profitable sites, old sites, blogs, doesn’t matter. You honestly don’t want to have illegal images on any of your websites, do you?
Of course you don’t.
